NOTICES UNDER DATA PROTECTION ACT 1998

Use of information about individuals associated with your business.

1) We,Venture Finance PLC of Sheencroft House, 10-12 Church Road, Haywards Heath, West Sussex, RH16 3SN need you to provide us with a list of your business’ current directors, partners, members, owners, shareholders and company secretary (as the case may be) and those of any holding company together with their residential addresses and to update us with of any future changes. We also need you to provide us with any information reasonably requested by us to enable us to comply with our obligations under any laws and regulations relating to money laundering or terrorist financing. 

2) Under the Data Protection Act each of the above individuals has a right to know how we will use any personal information about them, which either you provide or we obtain. This is set out below. We will also use it as shown in the Privacy statement on our website. 

3) We will store and process such information on our computers or on those of our group companies. We will use and disclose it (i) for the purposes of providing any agreed service, (ii) in connection with insurances obtained by us, (iii) to enforce our rights against any person, (iv) to enable our agents, advisers or partners to provide us with their services,(v) to assist our brokers and introducers (vi) to facilitate any transfer of debts, our business or our shares (vii) checking applications for (or managing) insurance or credit and related accounts, facilities and services, (viii) keeping accounts, (ix) statistical analysis, (x) recovering debts and (xi) dealing with claims. This information may also be used for checking details of job applicants and employees 

4) We will search each individual's details at a licensed credit reference agency and/or fraud prevention agency and keep the results.We will also keep the results of any other enquiries we make in accordance with our normal procedures. The credit reference and fraud prevention agencies will keep details of our searches and any information that we provide to them about the business or any dealings with us. 

5) If at any time we are provided with false or inaccurate information, and fraud is identified or suspected, details will be passed to fraud prevention agencies where it may be accessed and used by law enforcement agencies in this country and overseas. We and other organisations that make searches may also access and use this information to prevent fraud, money laundering or terrorist financing and for any purpose described in paragraph 3 above. 

6) We can give out information about individuals if we have a legal duty to do so or if the law otherwise allows. We may monitor and/or record phone calls for training and/or security purposes 

7) If any individual referred to above wants to have details of the agencies from whom we obtain and to whom we pass information, they should contact the Data Protection Officer at Venture Finance PLC on 01444 441717. They have a legal right to these details. They are also entitled to receive a copy of the information that we hold about them if they apply to us in writing to the address stated in paragraph 1 and pay the statutory fee.

CONFIRMATIONS for Venture Finance PLC from Primary Contact Named in Direct Application

I attach the list required under paragraph 1 above. I confirm that the information given therein is accurate, complete and correct to the best of my knowledge and belief. I declare that I am irrevocably authorised by the individuals referred to in the next sentence to give you the information in the list and the following confirmation. that all the current directors, company secretary, partners, members, owners or shareholders of the business and of any holding company are listed therein and that they have all read and understood a copy of the above notice explaining how Venture Finance PLC will obtain and use information about them and the searches and reports that will be made. They all consent thereto. Until notice from me to the contrary, and in relation to the Company named in the application form and any holding company, I undertake that I will advise you of any subsequently appointed directors, partners, members, shareholders, or company secretary and that they each will be provided with a copy of the above notice and (unless I tell you to the contrary ) that they will read and understand its contents and consent to the searches that you will make and your use and disclosures of information about them. I am authorised to receive, at the business’ address, all notices from you under the Data Protection Act 1998 in respect of all such individuals, until I tell you from to the contrary.
